REGULAR MEETING

December 12, 2023

Katie Blume called the meeting to order at 7:00 PM with the pledge of allegiance. Council members in attendance: Robert Zeigler,  Cecilia Gallup and Beth Cowher also in attendance Cim Besecker Borough Treasurer/Assistant Secretary, Sherry Corman Borough Treasurer/Assistant Secretary and Solicitor John Miller.  Absent Nickelaus Engle, Denise Immel, Borough Secretary and Mayor Steve Myers

Citizens present: Mike Hanson from Penns Valley Little League

A motion was made by Cecilia Gallup to approve the November 14, 2023 minutes, pending spelling corrections on Zeigler, Blume and Gallup, seconded by Robert Zeigler. Motion passed.

A motion was made by Robert Zeigler to approve the November 2023 financials as presented, seconded by Cecilia Gallup. Motion passed.

Code Enforcement/HARB/Planning Commission reports:

The Code Enforcement report was reviewed with no questions or comments. No reports from HARB or the Planning Commission.

Employee Reports:

Cim Besecker accepted the treasurers position her start date was December 5, 2023.

Recycling bins have been distributed, a few residents didn’t want the bins and some wanted more than one. Within a few days all of the bins got sorted out. All equipment is ready for winter and mowers have been winterized. Christmas decorations were put up, including the Christmas tree at Fountain Park. The water fountain at the park has also been winterized.

The water plant is running smoothly.

Due to a loose hose on one of the membranes a high fecal count was received at the sewer plant. The hose is fixed and the plant is back to no-detect on fecal count.

The information from the new meter at the dam weir requires a lap top for downloading of information, the water plant does not have access to one. Robert Zeigler made a motion to allocate up to $1,500.00 for purchase of laptop and necessary programs, seconded by Beth Cowher. Motion passed.

New Action Items

Invoices

Beth Cowher made a motion to pay Buchart Horn invoice 122583 in the amount of $1,787.26 and invoice 122373 in the amount of $4,479.30 for services rendered on equalization tank, seconded by Cecilia Gallup. Motion passed.

Beth Cowher made a motion to pay Greenland Construction their third installment in the amount of $29,450.00 for services rendered on the plant screen and dam weir project, seconded by Cecilia Gallup. Motion passed.

Zoning board:

Robert Zeigler made a motion to appoint Jeff Stover solicitor for the zoning committee, seconded by Cecilia Gallup. Motion passed.

Article for website:

Ed Carter has requested the Borough publish his article entitled “How Your Small Enterprise Can Nourish Your Neighborhood” on the Millheim Borough webpage. Robert Zeigler made a motion to approve publication, seconded by Beth Cowher. Motion passed.

Staff reviews:

Katie Blume is meeting with each employee for a review. She is encouraging each one to attend training to enhance professional development.

Holiday items for review:

Robert Zeigler made a motion to give $100.00 to employees who have been with the borough since January 2023 and $50.00 to employee hired after July 2023 as a token of appreciation, seconded by Beth Cowher. Motion passed.

Direct deposit:

We have been notified that QuickBooks will be increasing from $1.75 per paycheck to $4.00 per paycheck. Robert Zeigler made a motion to continue with direct deposit at $4.00 per paycheck, seconded by Beth Cowher. Motion passed.

LST contract:

Our current contract with Centre Tax Agency for Local Services Tax (LST) collection services is set to expire on December 31, 2023. Beth Cowher made a motion to renew the contract as presented, seconded by Cecilia Gallup. Motion passed.

Tax resolution:

Robert Zeigler made a motion to adopt Resolution 2023-12 levying the tax rate for the year 2024 at the same rate of 4.00 mills on the value of real property located with the Borough of Millheim, seconded by Cecilia Gallup. Motion passed.

Old Action Items

Infrastructure updates:

Dam weir:

Contractor has returned and completed the installation of the metering device at the dam. A substantial Completion Inspection will be performed and punch list created of incomplete work and then the project will be ready for final payment.

Liquid Fuels:

The application for funding from Centre County has been denied.

Bridge project:

The final design of the bridge footing that will support the bridging structure is being completed. Once completed we will proceed to the bidding phase. The plan is to bid this work this winter and award immediately to allow the shop fabrication work to take place prior to a time when field conditions are suitable.

Equalization tank:

Buchart Horn is currently working with a controls group to ensure the proper control phasing of the pump station and the tank. Once completed they will finalize the design for operator review. They have reached out to the operator to confirm the models of pumps and the pumping station to finalize the control design of the tank. They are also are preparing the DEP Permit Application to have this treatment added to the plant.

2024 LSA Grant:

The LSA Grant application was submitted on behalf of the Borough. The project submitted is to replace the old main water line along North Street.

2024 Multimodal grant open:

This grant is set to expire on June 30, 2024. This grant is for $300,000 and no funds have been drawn down. Beth Cowher made a motion to request an extension for another year (June 2025) to complete the project, seconded by Robert Zeigler. Motion passed.

VCBA update:

Summerfest is scheduled for July 27 and July 18, 2024. VVCBA is researching the possibility of closing Penn Street from Race Street to Mill Street for vender booths. They are also researching a Halloween parade and Christmas parade.

Streets and parking:

After review of the road descriptions, Robert Zeigler made a motion to have Solicitor Miller draft the ordinance for ordained streets in the Borough, seconded by Cecilia Gallup. Motion passed.

Little League:

Penns Valley Little League presented a proposal to renovate the old gymnasium into an indoor training area for players. This would include batting cages and pitching mound. PVLL is willing to supply labor and materials for the project. Robert Zeigler made a motion to have Solicitor Miller draft a lease for the use of the space, lease to include a clause prohibiting PVLL from renting the space to other organizations, labor and materials will be used as rental fee, seconded by Beth Cowher. Motion passed.

Pool/Recreation:

A proposal for inspection of the swimming pool has been received, $6,750.00. The swim team has researched the cost of a feasibility study for the pool cost would be around $15,000.00, they are also considering the possibility of running Penns Valley Park and Rec Association. Grants are being investigated. Discussion was held on forming a Recreational Authority.

All believe the pool is a valuable part of Penns Valley and we need to try to find a way to save.

Center Street Ordinance:

Robert Zeigler made a motion to adopt Ordinance 276 amending Chapter 15, part 3, section 305 of the Millheim Borough Code of Ordinances by prohibiting parking, standing or stopping of vehicles on the north side and the south side of the right-of-way of Center Street from Penn Street to Water Street, seconded by Beth Cowher. Motion passed.

November 14, 2023

Katie Blume called the meeting to order at 7:00 PM with the pledge of allegiance. Council members in attendance: Robert Zeigler, Nickelaus Engle, Cecilia Gallup also in attendance Denise Immel Borough Secretary/Assistant Treasurer, Sherry Corman Borough Treasurer/Assistant Secretary and Solicitor John Miller.  Absent Beth Cowher and Mayor Steve Myers

Citizens present: Chris Evans and Mike Hanson from Penns Valley Little League and Beth Cottrell

Citizens input: Penn’s Valley Little League would like to work on an agreement with the Millheim Borough for the use of the gymnasium located in the Borough building basement. The proposed use would be for indoor batting cages and Penns Valley Little League would supply labor and supplies for the work. Katie Blume requested Penns Valley Little League present a written proposal of all improvement they would like to do for council to consider.

A motion was made by Cecilia Gallup to approve the October 10, 2023 minutes as presented, seconded by Robert Zeigler. Motion passed.

A motion was made by Robert Zeigler to approve the August 2023 financials as presented, seconded by Cecilia Gallup. Motion passed.

Code Enforcement/HARB/Planning Commission reports:

The Code Enforcement report was reviewed with no questions or comments. No reports from HARB or the Planning Commission.

Katie Blume made a motion to appoint Bradley Johnstonbaugh ll to a three year term on the Millheim zoning committee Curt DeSousa to a 2 year term on the zoning committee and William Wolfe to a one year term on the zoning committee. Seconded by Robert Zeigler, Motion passed

Employee Reports:

Brush and leaf collection has started and we will be collecting leaves through the week of November 13, 2023. Beginning of the month the new zero turn mower was ordered and picked it up a week later at Hoover Tractor Mowing is winding down and borough properties are being cleaned up for the winter months. Christmas decorations are ready to be put up, and will be done after Thanksgiving. A lift will need to be rented again this year to hang the decorations.

 Penns Valley Little League reached out about using the Gym space, a meeting was held with them and they should be presenting their proposal.

Moving further into November the equipment will be winterized. With the purchase of the zero turn the Steiner tractors have already been winterized for fall clean up and winter snow removal.  

Our road crew feels it would be in the best interest to start paving some roads. Just trying to get some sections done a little at a time. More complaints are being received from residents on the condition of local roads.

The water plant had an inspection of October 27, 2023 with no new findings. On November 02, 2023, a major leak was discovered on Church Street, notification came in at 4:00AM, located by 7:45AM, and fixed by 10:30 AM. No residents were affected by the leak as water was rerouted. The leak totaled 140 gallons per minute or 200,000 gallons per day.

A request for the purchase of a manual fork lift, to be used to move chlorine canisters was presented to council. The maintenance crew and water operator currently move these by hand, risking back injuries or other physical injury. Robert Zeigler made a motion to purchase a Dayton manual Fork-Over Stacker for $1,200.00, seconded by Nickelaus Engle. Motioned passed.

Storage space for new equipment was discussed with no decisions at this time.

Cecilia Gallup made a motion to place an ad in the Bargain Sheet advertising our back hoe, cub cadet and dehumidifier for sale thru the sealed bid process, seconded by Robert Zeigler, Motion passed.

Robert Zeigler made a motion to donate the office copier to a non-profit organization, seconded by Nickelaus Engle. Motion passed.

Road paving was discussed with Hillcrest Avenue and Cherry Street mentioned as possibilities as it is believed these both qualify under as liquid fuels roads.

New Action Items

Invoices:

Robert Zeigler made a motion to pay Pennsylvania rural water membership dues in the amount of $529.00, seconded by Nickelaus Engle. Motion passed.

Robert Zeigler made a motion to pay Pennsylvania State Association of Boroughs membership dues in the amount of $228.00 along with the Pennsylvania State Association Boroughs plus program training subscription in the amount of $450.00, seconded by Cecilia Gallup. Motion passed.

A motion was made by Cecilia Gallup to pay invoice 120928 in the amount of $575.00 to Buchart Horn for professional services rendered on plant screen and dam weir, seconded by Robert Zeigler. Motion passed.

Budget:

A motion was made by Robert Zeigler to approve and adopt the 2024 budget for the Millheim Borough as advertised, seconded by Nickelaus Engle. Motion passed.

Solvency Fee: not needed

APPI-Constellation:

A motion was made by Robert Zeigler to discontinue the contract with Constellation that provides the electrical power to the Borough and return to West Penn Power effective December 31st 2023 seconded by Nickelaus Engle. Motion passed.

Resolution 2023-10 Fire Company:

Robert Zeigler made a motion to adopt resolution number 2023-10 authorizing the expenditure of $2,746.32 from the funds collected from the fire tax to the Millheim Fire Company for truck loan payments, seconded by Cecilia Gallup. Motion passed.

Treasurer’s Position:

Robert Zeigler made motion to accept the resignation of Sherry Corman as treasurer, effective December 31st 2023 seconded by Cecilia Gallup. Motion passed.

Following the recommendation from the Personnel Committee, Robert Zeigler made a motion to offer the treasurer’s position to Cim Besecker, with a probationary salary of $15.00 per hour following the 90 day probationary period, salary will be raised to $16.00 per hour. Should Ms. Besecker decline the position the same offer will be made to Brenda Burd seconded by Cecilia Gallup. Motion passed. 

Meeting dates:

Robert Zeigler made a motion to approve the Millheim Borough Council meetings, Millheim HARB committee meetings and the Millheim Planning Commission meeting as presented, seconded by Cecilia Gallup. Motion passed.  

Sewer License Bonus:

Robert Zeigler made a motion to issue Justin Kerstetter his $500.00 bonus from the sewer funds for passing the final sewer exam, as per previously agreed, seconded by Nickelaus Engle. Motioned passed.

Infrastructure updates:

Solar at Sewer:

Construction is expected to begin in early December. The racking installation will begin on 12/11/2023,   with the trenching and access roads completed the week prior.

Dam weir:

Greenland Construction is progressing with the work, and it is nearly complete. The meter and level sensor still need to be installed. The delivery date for the meter is still undetermined, and Greenland is hearing that it will ship December 6th. 2023 Greenland construction has submitted an application for payment number two in the amount of $11,875.00. Cecilia Gallup made a motion to approve payment to Greenland Construction in the amount of $11,875.00, seconded by Robert Zeigler. Motion passed.

Liquid fuels – bridge project:

A site meeting was held on April 2023 with a bridging company. Buchart Horn is still waiting on their final proposal for pricing. The plan is to bid this work this winter and award immediately to allow the shop fabrication work to take place Prior to a time when field conditions are suitable. Nothing has changed since October’s report.

LSA Grant application:

CFA has opened the LSA grant program with applications being accepted until November 30 the 2023. Buchart Horn has prepared Resolution 2023-11, requesting a Statewide Local Shares Assessment grant for $900,000.00 from the Commonwealth Financing Authority to be used for the North Street Water. Main Replacement Project. The resolution also designates Katie Bloom Council President and Nicholas Engel Council vice president as the officials to execute all documents and agreements between Millheim Borough and the Commonwealth financing authority to facilitate and assist in obtaining the requested grant. Robert Zeigler made a motion to adopt Resolution 2023-11 as presented, also authorizing the payment of the $100 application fee, seconded by Nickelaus Engle, Motion passed.

Streets:

A motion was made by Robert Zeigler to divide Stover Avenue into E Stover Avenue from Pine Street to Sycamore Street and W Stover Avenue from North High Street to dead end, seconded by Cecilia Gallup. Motion passed.

A motion was made by Robert Ziegler. To have Second and Third Street signs with letters instead of numbers, seconded by Cecilia Gallop. Motion passed.

Center Street parking:

Little League:

Pool/Recreation:

The condition of the Soldier and Sailors Memorial pool is deteriorating quickly. The pool is basically dying. There is crumbling concrete, pipes under the pool are leaking and no funds are available to cover all the repairs required. Currently the property is owned by the Millheim Lions Club. Solicitor Miller will

Perform a deed search trying to track if there are any clauses about ownership reverting back to any organization or company. Robert Ziegler will do research on the cost of a feasibility study for maintaining and operating of a pool at Soldier and Sailors Memorial Park.

Secretary’s Report

Claren Court

Brookside homes has been contacted to supply a legal description of the road in Claren Court. This is the first step in having the road transferred to the Millheim Borough.

CD Renewals:

Three accounts are up for renewal with Mifflinburg Bank. They will offer a 12 month rate of 5.30% with no penalties for early withdrawals. First National Bank will offer 4.80%. Robert Zeigler made a motion to keep the accounts at Mifflinburg Bank provided we can do deposits as well as withdrawals, second by Nickelaus Engle. Motion passed.

PennVest Transfer:

Robert Zeigler made a motion to transfer $13,237.00 from the water fund checking to the water project construction account (PennVest) to cover loan payments for 12 month, seconded by Cecilia Gallup. Motion passed.

Tax Collector rent:

The Borough tax collector has been paying $100.00 rent to the Borough for the use of the Borough office. This space is used for 12 nights a year totaling, 24 hours a year.  Robert Zeigler made a motion to void any rental agreement between the Millheim Borough and the Millheim Borough Tax Collector effective with tax year 2023, seconded by Nickelaus Engle. Motion passed.

OCTOBER 10, 2023

Robert Zeigler called the meeting to order at 7:00 PM with the pledge of allegiance. Council members in attendance: Cecilia Gallup and Beth Cowher, also in attendance Denise Immel Borough Secretary/Assistant Treasurer, Sherry Corman Borough Treasurer/Assistant Secretary and Solicitor John Miller.  Absent Katie Blume, Nickelaus Engle and Mayor Steve Myers.

Citizens present: Angela & Bradley Johnstonbaugh, Fred Johnson, John Bruno, Rusty Long, John Segursky representing Buchart Horn, Bob Barry and Cindy Ross representing Penns Valley EMS, Brandon Musser and Michael Hanson representing Penns Valley Little League and Chris King

Citizens input: A group of concerned citizens expressed their thoughts on the safety of parking on both sides of Penn Street as well as on both sides of Center Street. Concerns included not being able to make the turn from Penn Street on to Center Street, especially for larger vehicles or vehicles towing trailers or campers, because of vehicles parked on the south side. Especially during the winter months when the road ices and it becomes difficult to keep from sliding into to a parked vehicle. Council members and administration stated they have heard this scenario via phone conversation and street conversation over the past year. Due to safety concerns of council members, Cecilia Gallup made a motion to have solicitor John Miller draft a new ordinance designating Center Street no parking on both sides, seconded by Beth Cowher. Motion passed.

Citizens also stated that it is becoming more difficult to pull out from side streets onto Penn Street due to increased parking on both sides of Penn Street between Mill Street and the borough line. When this occurs they feel Penn Street becomes more of a one lane street than the two lane street as it is designated to be by PennDot.  Residents state that on many occasions, they have to pull out onto Penn Street to be able to see if there is oncoming traffic. Council agreed to contact PennDot to request a feasibility study and to research the feasibility of designating Penn Street as no parking on either.

A motion was made by Cecilia Gallup to approve the September 12, 19 and 26, 2023 minutes as presented, seconded by Beth Cowher. Motion passed.

Employee Report:

Roadside drains and drainage areas have been cleared. The stop sign and stop sign replacement projects have been completed.  Quotes have been received for an additional zero turn mower. Quote from Millheim small engine was $13,500 for the exact mower we currently have, a second option for $6,500 was also received from Millheim Small Engine This mower has a much smaller mowing deck and less fuel capacity. Hoover Tractor quoted as $7,000 for a similar model to our existing mower. The recycling bins have been delivered and are being stored in the old gymnasium. The road salt order has been delivered and anti-skid material has been ordered for the winter season. Plows, trucks and salt spreaders have been serviced for the winter season. Fall cleanup will begin October 23rd.

Cecilia Gallup made a motion to purchase the new zero turn mower from Hoover Tractor, seconded by Beth Cowher. Motion passed.

A motion was made by Beth Cowher to approve the payment of invoice number 121764 in the amount of $3289.50, and invoice number one to 121767 in the amount of $1,865.00 to Buchart Horn seconded by Cecilia Gallup. Motion passed. 

Budget:

After final review. Beth Cowher made a motion to advertise the proposed 2024 budget, seconded by Cecilia Gallup. Motioned passed.  Secretary Immel will see that the advertisement is placed.

EMS Agreement:

Bob Berry and Cindy Ross were present to present the joint municipal agreement for the Penns Valley EMS.  This agreement is requesting that each municipality contribute to the Penns Valley EMS an amount equal to ½ mil of the taxable basis of all properties located in its individual municipality for the current year. Beth Cowher made a motion to authorize Robert Zeigler to sign and agree to the document as presented by, seconded by Cecilia Gallup. Motion pasted.

Baseball field:

 Brandon Musser and Michael Hanson, representing the Penn’s Valley Little League, are requesting permission to create a 50/70 field, which will create a field for 11 to 13 year olds to compete. This will require moving the fence back     feet. A motion was made by Beth Cowher to allow Penns Valley Little League to move the fence back by number of feet to create the 50 70 field, seconded by Cecilia Gallup. Motion passed.

Penns Valley Little League would also like to build an attachment to the existing concession stand to house maintenance equipment and baseball equipment. A motion was made by Cecilia Gallup to allow Penns Valley Little League to build an addition on to the concession stand for storage use, seconded by Beth Cowher. Motion passed.

Mr. Musser and Mr. Hanson expressed safety concerns for both players and spectators in regards to the trees that are surrounding the baseball field and surrounding area. They feel that the trees are quite old and present safety concerns with falling limbs. Council agreed to have a tree specialist inspect the trees for safety issues and to receive estimates for removal of all trees and for removal of any safety concerns. Ben Haupt will be contacted for opinion on trees.

Byler parcel zoning:

Chris King presented council with a request for a usage variance on parcel code 33-003-,007-,0000-. Mr. King would like to construct a small manufacturing plant for porch bed swings. These are currently being manufactured at his residence in Penn Township. Council tabled request pending outcome of zoning hearing board.

Screen replacement project:

This project is nearly complete. The meter and level sensor still need to be installed A double basket screen was moved into a manhole at the plant site. This provided cost savings and easy access. Greenland construction has submitted application for payment number one in the amount of $159,125.  Cecilia Gallup made a motion to approve payment to Greenland construction and authorizing Robert Ziegler to sign contractor’s application, seconded by Beth Cowher. Motion passed.

DCED multimodal grant bridge project:

Buchart Horn is still waiting on a proposal for the pricing. They will then incorporate the detailed drawings. It is the plan to have bid requests for this work out this winter and awarded immediately to allow the shop fabrication work to take place prior to a time when field conditions are suitable.

WWTP Project – Equalization Tank:

 Case mapping for the site plan is being completed, and the preliminary design will be presented to the operator for review. The DEP permit application is being prepared to have this treatment added to the plant.

LSA Grant Application:

Millheim Borough is receiving $400,000.00 from the Local Share Accounting program. This grant is to replace the raw water line from the dam to the new main along SR0445 and a section farther down toward town.  This program does not have a match component. Buchart Horn will present an agreement to council to begin this process.

CFA has opened the LSA grant program. Applications are being accepted until November 30th. 2023.

Streets: no updates at this time

Christmas decorations:

Robert Zeigler made a motion to have Beth Cowher select and purchase (8) new decorations for the light poles on Main Street and borough building, decorations cost not to exceed $7,500.00 funds to be taken from general and or beautification fund, seconded by Cecilia Gallup Motion passed.

Reichard Cemetery:

West Penn Power will not grant permission for the monument to be constructed on their easement.

VCBA update:

VCBA is requesting Millheim Borough to send separate invoices to Happy Valley Adventure Bureau, $6,250.00 for the Summerfest Grant and $10,000.00 for the Route 45 Getaway grant. Treasurer Corman will send invoices to Happy Valley Adventure Bureau.   

Secretary’s Report

Fireman Relief Funding:

Funding has been received from the Auditor General’s office in the amount of $4,613.92. These funds are supporting the volunteer and have been forwarded to the Millheim Fire Company.

Pension funding:

Funding has been received from the auditor general’s office in the amount of $8,429.82.   This is the state’s portion of our pension plan. The 2023 employer balance is $1,470.18. Funds totaling $9,900.00 have been sent to PSAB to satisfy the minimum municipal obligation for our pension.

New copier:

During the recent repairs of our current copier it was noted that the copier is obsolete and that replacement parts are no longer being made. A recommendation was made to purchase a new copier now before we are unable to repair our existing copier. A quote has been received from Nittany Office equipment to purchase a Sharp MX-C303W8 desktop copier. Beth Cowher made a motion to purchase said copier in the amount of $2,140.00 from Nittany office equipment, seconded by Cecilia Gallup. Motion passed. Secretary Immel will notify Nittany Office.

Recycling Bins

Our maintenance staff has delivered the recycling bins, each residence should have received at least 1 bin, we apologize for not be able to disburse 2 bins to each of you, we were not supplied with enough bins for each of you to receive 2, if you do not want the bins or only need 1, please call 814-349-5350 or 814-360-2984 or email millheim@verizon.net and we will pick up and deliver to a resident who only received 1 bin. As a reminder there are recycling collection bins behind the borough building. 

Unfortunately we will not be doing curb side recycling pickup. We do not have the necessary equipment or funding to do this. The recycling bins we are providing can be emptied in the recycling containers behind the Borough building.  We encourage each of you to utilize these bins to recycle the items listed below, you are not only helping the environment but also saving money in trash fees.

Items that can be recycled include mixed paper, paperboard, magazines and newspaper. Corrugated cardboard, all boxes must be broken down. Plastics – bottles, jugs and jars. Glass – clear, green, brown. Steel and aluminum – cans and foil.

Items that cannot be recycled – batteries, styrofoam, paper plates, paper cups, glassware, ceramics and miscellaneous plastic.

BUDGET MEETING

September 26, 2023

Katie Blume called the meeting to order at 8:30 AM. Council members in attendance: Robert Zeigler, Cecilia Gallup and Nickelaus Engle. Fall newsletter:

The borough full newsletter was presented to council for review. The dates for the fall brush and leaf pickup were confirmed. There were no additional updates at this time.

Water account 2024 budget:

The water account budget was reviewed, income is in line with previous years, no changes should be needed. We will be required to do PFAS testing this year. We will need to increase the testing expense by at least $6000.00, will transfer these funds from the machinery and equipment expense. All other expenses appear in line with previous years, no additional adjustments needed.

Sewer account 2024 budget:

The sewer account budget was reviewed, income is in line with previous years, no changes should be needed. The backup membranes can be paid from COVID funds, thereby reducing capital improvements to $10,000. The budget for machinery and equipment should be reduced to $9,445.00. This provides a balanced budget for the 2024 fiscal year.

General account update:

The general account budget was reviewed with the changes agreed to at the September 19, 2023 meeting.  No additional changes required.

Street update:

The final draft of the street ordinance is in review with Center County government. Council will need to decide whether they wish to change Stover Avenue to East Stover Avenue and West Stover Avenue. Changing the avenue name will affect two resident’s street addresses.

Katie Blume called the meeting to order at 7:00 PM with the pledge of allegiance. A motion was made by Robert Zeigler to approve the July 12, 2023 minutes and the August 18, 2023 as presented, seconded by Nickelaus Engle. Motion passed.

Code Enforcement/HARB/Planning Commission reports:

The Code Enforcement report was reviewed with no questions or comments. No reports from HARB or the Planning Commission.

Employee Reports:

August consisted of a lot of busy work. A blown a tire on the skid steer required attention, Kuppel’s Auto gave us the best deal, there was almost had no wait time and staff very happy with the work. The skid steer was only down three days. In the meantime road projects were completed. That road project consisted of grading the berm down, leveling a drain area, fixing the road side, and then placing a new berm with cold patch. This has been working very well discharging the water properly.

With all the rain the mowing has been crazy, in reference, mowing was done 13 of the 31 days this month. This is with the Soldiers and Sailors property added in as well. Including mowing roadsides with the tractor, this is new to the list this year. The new boom mower is getting used more than anticipated.

Water and sewer are working fine.

A motion was made by Robert Zeigler to pay invoice 121279 in the amount of $3,182.50 to Buchart Horn for professional services rendered on plant screen and dam weir, and invoice number 121273 in the amount of $100.95 for 2023 NPDES renewal, seconded by Nickelaus Engle. Motion passed.

Lease agreement:

The Penns Valley Code lease agreement is set to expire December 31st 2023. It will then automatically renew every 12 month unless 30 day notification to cancel is given by either party.

The East Penns Valley Library lease agreement will expire December 31st 2024.

Liquid fuels:

The Centre County liquid fuels application was presented, the application must be submitted by 5:00 PM on Friday, October 20th 2023 to be considered for any 2024 funding. Funding can be used for road maintenance, new road construction, safety improvement to roads, repair or replace bridges, drainage improvement on roads, signals and signs for road or equipment and structures to be used for roads. Possible projects could include drainage on Mill Street, renewal of crosswalks on Penn Street, North Street and Main Street. 

Budget dates:

A motion was made by Robert Zeigler to establish the 2024 budget meeting dates for September 19th and September 26th beginning at 8:30 AM and Monday, October 22nd at 6:00 PM and Tuesday October 10th at 6:00 PM if needed. Seconded by Nickelaus Engle. Motion passed.

LST tax resolution 2023-09:

Robert Zeigler made a motion to adopt resolution 2023-09 authorizing the expenditure of $7,000.00 to Penns Valley Emergency Medical Services from the funds collected by the borough of Millheim from the local services tax, Seconded by Nickelaus Engle. Motion passed.

Screen Replacement project

The Preconstruction meeting was held on Friday September 8, 2023, and the Notice to Proceed was

issued. The contractor intends to be on site very quickly. At the Pro-Con a discussion was had about a couple possible changes to the project scope. The

contractor plans to submit cost impacts for those changes.

Bridge inspection:

PennDot had an inspection completed on the Park Road Bridge. Two priority 2 deficiencies were found.

Update on Solar Projects:

The solar panels should be delivered on site this week, Justin will confirm the correct placement options within the fence onsite. Mr. Omar confirmed the corn removal by mid to late October, construction will begin immediately following. Construction will into 2024 with an expected completion date of spring 2024.

Streets:

A revised edition of the ordained streets within the borough has been submitted to Centre County government and Center County 911 for review.

Human Rights Commission:

Robert Zeigler made a motion to adopt ordinance number #274 to establish a Regional Human Relations Commission, seconded by Nickelaus Engle. Motion passed.

Robert Ziegler made a motion to adopt ordinance #275 to ensure anti-discrimination, seconded by Nickelaus Engle. Motion passed. 

Secretary’s Report:

Maintenance crew is in need of new shirts and have requested sweatshirts instead of jackets. Additional costs may be involved for set up fees as we are looking for a new supplier.

Checking accounts:

As the HHC and Town Clock account do not have regular activity they are subject to dormancy fees if there is no client activity in    month. Robert Zeigler made a motion to deposit a dollar from the general account into the HHC account and the Town Clock account, seconded by Nickelaus Engle. Motion passed.
